第一条 为维护展会秩序,加强展会知识产权保护,根据《展会知识产权保护办法》和《北京市展会知识产权保护办法》等相关法律法规,制定本投诉处理程序。
Article 1 For the purpose of maintaining the order of exhibitions and strengthening the intellectual property protection at exhibitions, this Complaint Handling Procedure is formulated in accordance with the Measures for the Intellectual Property Protection at Exhibitions, the Measures of Beijing Municipality for the Intellectual Property Protection at Exhibitions and other relevant laws and regulations.
第二条 本程序适用于2023年世界地热大会展览期间(2023年9月13日至2023年9月17日)发生在展馆内的对大会使用和展出内容涉嫌侵犯知识产权或个人信息的投诉及处理。
Article 2 This Procedure shall apply to the complaints and handling of suspected infringement of intellectual property rights or personal information rights arising from the contents used and/or displayed at the exhibition venue occurred during the exhibition period of World Geothermal Congress 2023 (from 9/13/2023 to 9/17/2023).
第三条 投诉受理条件
(一)投诉人拥有合法、有效的知识产权,或是个人信息相关自然人;
(二)投诉人与被投诉事项具有利害关系;
(三)投诉是针对展会现场发生的涉嫌侵犯知识产权或个人信息的行为。
Article 3 Conditions for Accepting a Complaint
(I) The complainant has legal and valid intellectual property rights, or is a natural person with relevant personal information;
(II) The complainant has an interest in the matter being complained about; and
(III) The complaint is against the suspected infringement upon intellectual property rights or personal information rights occurring at the exhibition.
第四条 投诉人应向展会投诉受理机构提供下列资料:
(一)投诉人身份证明。自然人应当提供身份证件;法人或其他组织应当提供主体资格证明;
(二)授权委托证明。委托代理人的,应当提交授权委托证明和代理人的身份证明。
(三)知识产权或个人信息证明。具体包括专利证书、授权公告文本、专利登记簿副本、实用新型或外观设计的专利权评价报告等;商标注册证书;著作权登记证书或能够证明著作权的法律文件;商业秘密、个人信息相关权属证明材料。知识产权发生有关变更、续展、转让、许可等事项,还应对提交相关法律文件。
(四)侵权证明。具体包括涉嫌侵权参展项目的名称、涉嫌侵权内容的手册、照片、实物等。
(五)投诉申请书。申请书应包含投诉人、被投诉人、拟投诉事项、投诉理由及具体诉求等基本内容。自然人投诉的,应在申请书上签字;法人或其他组织投诉的,应在申请书上签字并盖章。
提交材料是外文的,必须有相对应的中文译本。
Article 4 A complainant shall provide the following materials to the complaint acceptance agency of the exhibition:
(1) Identity certificate of the complainant. Identity certificate in the case of a natural person, or subject qualification certificate in the case of a legal person or an organization;
(2) Power of attorney. Where an agent is entrusted, the power of attorney and identity certificate of the agent shall be submitted.
(3) Proof on intellectual property rights or personal information. Specifically, this includes patent certificate, declaration of authorization text, duplicate of patent register, patent evaluation report for utility model or design, etc.; trademark registration certificate; copyright registration certificate or legal documents that can prove copyright; trade secrets, personal information, and related ownership proof materials. In case of any change, renewal, transfer and licensing of intellectual property rights, the relevant legal documents shall also be submitted.
(4) Proof of infringement. Specifically, this includes the name of the exhibition item suspected of involving infringement, and the brochure, photos and real objects suspected of involving infringement.
(5) Letter of application for complaint. The letter of application shall include the name of the complainant, the party against whom the complaint is filed, the matters to be complained about, the reasons for the complaint, the specific demands, and other basic information. Where a natural person files a complaint, he/she shall sign the letter of application. Where a legal person or any other organization files a complaint, it shall sign and affix its seal to the letter of application.
If the submitted materials are in a foreign language, there must be the corresponding Chinese translation.
第五条 有下列情形之一的,展会投诉受理机构可不予受理:
(一)投诉人已经向知识产权行政管理部门提起侵权投诉、向人民法院提起侵权诉讼或向仲裁机构申请仲裁的;
(二)知识产权无效或处于无效宣告请求程序之中的;
(三)知识产权存在权属纠纷,正在由知识产权行政管理部门调解或处理,或由人民法院、仲裁机构审理的;
(四)投诉人提交的材料不符合第四条规定要求的。
Article 5 Under any of the following circumstances, the complaint acceptance agency of the exhibition may refuse to accept the complaint:
(1) The complainant has lodged a complaint of infringement to the intellectual property administrative department, lodged a lawsuit of infringement to the people's court or applied to an arbitration institution for arbitration;
(2) The intellectual property is invalid or is in the proceedings for requesting invalidation;
(3) The intellectual property is involved in any ownership dispute that is being mediated or handled by the intellectual property administrative department, or is being tried by the people's court or an arbitration institution; or
(4) The materials submitted by the complainant fail to meet the requirements of Article 4.
第六条 投诉处理程序如下:
(一)展会投诉受理机构受理投诉后,应当及时通知被投诉人,要求被投诉人在十二(12)小时内提交书面陈述意见和不侵权的证据。
(二)展会投诉受理机构受理投诉后,应在二十四(24)小时内对投诉侵权事项开展调查核实。
(三)经调查,投诉理由不成立的,展会投诉受理机构终止投诉处理;投诉成立确属侵权,或被投诉人未按时提供第(一)项所列资料,或被投诉人自认侵权的,展会投诉受理机构可要求被投诉人采取遮盖或撤展等措施。
Article 6 The procedures for handling a complaint shall be as follows:
(1) The complaint acceptance agency of the exhibition shall, upon acceptance of the complaint, notify the respondent in time and request the respondent to submit a written representation and evidence of non-infringement within 12 hours.
(2) Upon acceptance of the complaint, the complaint acceptance agency of the exhibition shall investigate and verify the infringement matters complained within 24 hours.
(3) Upon investigation, where the reason for the complaint is not tenable, the complaint acceptance agency of the exhibition shall terminate complaint handling; where the complaint is tenable and there is actual infringement, or the respondent fails to provide the materials listed in item (1) within time, or the respondent admits infringement, the complaint acceptance agency of the exhibition may request the respondent to take measures such as covering or withdrawing the conference and exhibition.
第七条 本处理程序由展会投诉受理机构负责解释。
Article 7 The complaint acceptance agency of the exhibition shall be responsible for interpretation of these Procedures.
